Tunica County Recreation Commission Tournament Contract The ASSOCIATION will be granted use of said Park for this period of time and will be responsible for reporting any unsatisfactory use or conditions, which affect the ASSOCIATION and the COMMISSION. The ASSOCIATION agrees to conduct their activities in strict and complete compliance with this Policy Letter No. 5, which shall be deemed a part hereof as fully and completely as if set out and copied verbatim herein. The ASSOCIATION agrees to provide the Tunica County Recreation Commission with the information required in Policy letter No.5 and any other materials (certificate of liability insurance) deemed necessary by the Director of Parks and Recreation, at least fourteen (14) days prior to the event. I/We have read and understand the policies and regulations as stated in Policy Letter No.5 and agree to abide by them. I/We understand that failure to abide by these policies and regulations may be cause for the revocation of the contract and forfeiture of funds. (See Page 3) I/We further waive any claim against the COMMISSION and assume all risks and hazards incidental to the use of the park facilities or of the conduct of the activities. SCOREBOARD OPERATION AND PRESS BOX: Due to previous years of scoreboard misuse TCRC will provide scoreboard operators at $6.00 per game at the expense of the Association. Association has option not to offer scoreboard services. NO ONE ALLOWED IN PRESS BOX EXCEPT UMPIRES AND ADULT STAFF OF ASSOCIATION 18 OR OLDER ONLY. IF PRESS BOX RULE IS ABUSED TCRC HAS THE RIGHT TO CLOSE DOWN THE PRESS BOX 12. Association will be responsible for field maintenance during the day. TCRC will prepare fields before and after games, also TCRC will drag fields at the request of Association. Concession and Restroom maintenance will be the Association responsibility. Dugouts are to be cleaned after each game and NO HITTING AGAINST FENCE. 13. Certificate of Liability Insurance list as an additional Insured Tunica County, Mississippi Tunica County Recreation Commission Brackets is required 14 days in advance Policy Letter # 5 Page 3 Section 1. The following policy shall be enforced by the Tunica County Recreation Commission. These policies shall apply to any and all fields under the jurisdiction of the Tunica County Recreation Commission. These policies are by no means meant to prohibit any individuals, groups or organization from utilizing Commission fields at anytime. The Tunica County Recreation Commission youth and adult programs shall have priority over all requests for field use. The Tunica County Recreation Commission reserves the right to schedule any special event, activities, and programs which might be reserved for the use of the fields during the year. Section 2. The Association shall pay the Tunica County Recreation Commission a fee of $1300 for use of complex plus other fees deemed necessary; or $250 per field per day plus other fees deemed necessary. Scoreboard operators are provided at the expense of the Association at $6.00 per hour per game. Section 3. All requests will require the $300 deposit which is non-refundable at the time of reservation. All other fees must be paid at least fourteen (14) days prior to the start of the tournament plus the following information must be on file: 1. a completed copy of contract, copy of liability insurance with Tunica County Recreation Commission as an additional insured, and tournament bracket. (Failure to provide the necessary documents may forfeit and or deny further usage. *TCRC is not responsible for providing tables and chairs for admissions or gate personnel, vendors or other outside necessities. Section 4. Security is mandatory TCRC will appoint security for events / Renting party (Association) will compensate security based on the number of hours the facility is requested but not to exceed $400.00. Section 5. All advertising material and promotional items must be approved by the Commission prior to soliciting participants for tournament. Failure to provide the correct information for approval may result in forfeiture of usage of facility. Section 6. Association shall obtain and retain throughout the term of this contact the following insurance coverage: Broad form comprehensive general liability insurance including (i) premises/operation, (ii) products completed operations hazard, (iii) broad form contractual, and (iv) personal injury. The general liability insurance shall include limits of liability of not less than $1,000,000.00 combined single limits for bodily injury and property damage. The insurance policies shall name Tunica County, Tunica County Recreation Commission, their officials, staff, and or/ all of them as additional insured. Insurance policy is due at least 14 days prior to tournament date. Association shall not subcontract fields for any other party. In the event of violating any of the above of section 5, it may result in termination of contract and forfeiture of funds. Section 7. Association shall be responsible for all other expenses for damages and destruction due to unsportsmanlike differences by any party involved in the event. All facilities and property are governed under a Zero Tolerance Policy. * No Smoking, alcohol, illegal substances, profanity or unruly conduct, sexual misconduct or indecent exposure, weapons or vandalism of property, coolers or outside food or drink, and no pets allowed. Any participant in violation of the rules and regulations posted at the entrance of the Complex are subjected to criminal prosecution. Section 8. The Commission staff shall have final say in any game cancellations which might come from inclement weather or conditions which warrant stoppage of said tournament. _______ Initial All Contracts and Athletic Field Forms must be completed and delivered to the Director of Parks & Recreation for final approval.
